Welcome to Freego Mexico. These Terms and Conditions ("Terms") govern your use of our website and the purchase of our electric bicycles and related products (collectively referred to as "Products"). By accessing or using our services, you agree to these Terms. If you do not agree, please do not use our services.
1. Online Store Terms and Conditions
1.1. You must be at least 18 years of age to use this website or purchase our Products. If you are under 18, you may only use this website with the involvement and supervision of a parent or guardian.
1.2. By placing an order, you represent and warrant that the information you provide is accurate, complete, and up-to-date. It is your responsibility to keep your contact information up to date.
2. Product Availability
2.1. All products are subject to availability. We reserve the right to limit the quantities of products we offer, especially during promotions.
2.2. We may discontinue any product at any time without prior notice. In the event of discontinuation after you have confirmed your order, we will contact you to offer an alternative or a refund.
3. Prices and Payments
3.1. Our Product prices are in Mexican Pesos (MXN) and are subject to change without notice. We reserve the right to modify or discontinue any Product at any time.
3.2. The published prices do not include VAT (Value Added Tax), nor shipping, handling or other applicable charges, which will be added and clearly itemized during the payment process.
3.3. We accept various payment methods, as indicated on our website (credit/debit cards, electronic transfers, cash payments at authorized establishments, etc.).
3.4. You agree to pay all charges incurred through your account, including applicable taxes. Payment must be completed in full to process your order.
4. Shipping and Delivery
4.1. Shipping times and delivery dates are estimates and are not guaranteed. Deliveries are made through national courier services. Freego Mexico is not responsible for any delays caused by the logistics provider, Mexican customs, or factors beyond our control.
4.2. Ownership and risk of loss or damage to the Products transfer to you upon physical delivery and signature of the delivery receipt at the address provided. It is important to inspect the package upon receipt and notify the carrier and us of any visible damage immediately.
5. Returns and Refunds
5.1. We accept returns of new, unused products in their original condition within 7 calendar days of the delivery date. To initiate a return, you must first contact our Customer Service department to obtain an authorization (RMA). Products must be returned in their original packaging, with all accessories, manuals, and labels.
5.2. A restocking and handling fee of up to 15% of the product value may apply and will be deducted from your refund. This fee covers inspection, reconditioning, and reverse logistics costs.
5.3. If the returned product is missing parts, accessories, or the packaging is damaged, additional charges equivalent to the cost of the missing items or the depreciation of the product will be applied, which will also be deducted from the refund.
5.4. The refund will be processed to the original payment method within 30 business days of us receiving and verifying the returned product at our service center. Original shipping charges are non-refundable.
6. Limited Warranty
6.1. All Products are covered by a Limited Manufacturer's Warranty for a period of two (2) years from the date of purchase, which covers only manufacturing defects in materials and workmanship under normal use. This warranty is valid only for the original purchaser and requires proof of purchase.
6.2. The warranty does NOT cover:
- Damage from accident, fall, collision, misuse, negligence or unauthorized modifications.
- Damages due to commercial use, rental or competition.
- Normal wear and tear of parts (such as tires, brakes, seat, transmission components).
- Cosmetic damage (scratches, dents).
- Damage caused by extreme weather conditions, fire, flood or external factors.
- Problems arising from the use of non-original Freego chargers, batteries or parts.
- Products purchased through unauthorized sellers.
6.3. To claim under the warranty, you must contact our Customer Service. We may require you to send the Product, at your expense, to an authorized service center for evaluation. If a defect covered by the warranty is confirmed, our liability will be limited, at our option, to repairing the Product, replacing the defective part, or replacing the Product.
7. User Responsibility and Security Warnings
7.1. You are responsible for ensuring that both you and any user of our Products are aware of and comply with ALL applicable federal, state, and municipal traffic laws, regulations, and rules in Mexico related to the use of bicycles and electric vehicles. This responsibility includes, but is not limited to: verifying whether registration, license, insurance, minimum age, speed limits, and permitted routes are required.
7.2. The use of electric bicycles carries inherent risks of serious injury or death. You accept these risks. It is your responsibility to ALWAYS use appropriate safety equipment, including a certified helmet and, we recommend, protective clothing, gloves, and lights. You must operate the Product safely, in a controlled and responsible manner, thoroughly reading the user manual before first use.
8. Exclusion and Limitation of Liability
8.1. To the maximum extent permitted by applicable law in the United Mexican States, Freego Mexico, its affiliates, distributors, employees or representatives, SHALL NOT BE LIABLE for any direct, indirect, incidental, special, consequential or exemplary damages (including, without limitation, damages for loss of profits, business interruption, personal injury or death) arising out of the use, misuse, inability to use, unauthorized modification or malfunction of any Freego Product, even if advised of the possibility of such damages.
8.2. Our total liability, in any event, will not exceed the purchase price paid for the specific Product that gave rise to the claim.
9. Intellectual Property
9.1. All content on this website (text, graphics, logos, images, software) is the property of Freego or its licensors and is protected by Mexican and international intellectual and industrial property laws. Its reproduction, distribution, or unauthorized use is prohibited.
10. Compensation
10.1. You agree to indemnify, defend and hold harmless Freego Mexico, its affiliates, directors and employees, from and against any and all claims, demands, losses, liabilities, damages, costs or expenses (including attorneys' fees) arising out of your use of the Products, your breach of these Terms, or your violation of any law or the right of a third party.
11. Amendments and Applicable Law
11.1. Freego Mexico reserves the right to modify these Terms at any time. Changes will take effect immediately upon posting on the website. Your continued use of the site or the Products after such changes constitutes your acceptance of the revised Terms.
11.2. These Terms shall be governed by and construed in accordance with the laws of the United Mexican States. Any dispute relating to these Terms or the Products shall be subject to the jurisdiction of the competent courts of Mexico City, expressly waiving any other jurisdiction that may apply.
